HEREFORDSHIRE COUNCIL DECISION DOCUMENT JUNE 17

Following publication of the Examiner’s Report, Herefordshire Council have published the Decision Document which confirms modifications to be made and that the Neighbourhood Plan will go to a parish referendum. They have also published a new Environmental Report and Habitats Regulation Assessment Addendum. THE EXAMINER’S REPORT

The Examiner has recommended to Herefordshire Council that subject to the modifications proposed in her report that it proceeds to a referendum.

THE INDEPENDENT EXAMINATION OF THE NEIGHBOURHOOD PLAN APRIL 2017

The Neighbourhood Plan has gone for independent examination and we will update the Neighbourhood Plan News page as we get further news. The Progress to Examination Report and Representations Received following the second Regulation 16 consultation can be seen at the bottom of the Kingsland Neighbourhood Plan page on the Herefordshire Council website here .

The Examiner has asked a number of questions of clarification with regard to the neighbourhood development plan, which can be seen here – Questions of Clarification from the Examiner.

SECOND REGULATION 16 PUBLIC CONSULTATION 11TH JULY TO 22ND AUGUST 2016

From 11th July to 22nd August 2016, Herefordshire Council is conducting a second ‘Regulation 16’ public consultation on Kingsland Parish’s Neighbourhood Development Plan.

There will be official site notices for the consultation in the Post Office, on the main village notice board and Parish Council notice board as well as a link to it here

  • The Neighbourhood Development Plan which is supported by maps of the Parish, and policy maps for Kingsland Village, Shirlheath and Cobnash.
  • The Consultation Statement which lays out the processes followed and outcomes of our consultations with residents, businesses and organisations in the parish and ‘statutory consultees’ that we are required to consult.
  • The Basic Conditions Statement which outlines how our Plan and policies conform with local (Herefordshire Core Strategy) and national (National Planning Policy Framework) planning law, as well as European regulations – particularly in relation to the environment and human rights.
  • Herefordshire Council also carried out an Environmental Report and a Habitats Regulations Assessment.

Kingsland Parish Council submitted their Neighbourhood Development Plan and all the accompanying documents to Herefordshire Council on 9th November 2015 and a revised plan on 7th July 2016.

KINGSLAND PARISH NEIGHBOURHOOD DEVELOPMENT PLAN

CONSULTATION ON COBNASH AND SHIRLHEATH OPEN TO ALL RESIDENTS OF KINGSLAND PARISH

Changes to Herefordshire’s Core Strategy mean that:

Our original proposals for the parish, as in the draft Neighbourhood Plan, largely stand but we are now required to consider

> defining a settlement boundary in Shirlheath and

> whether Cobnash should have some development and if so, where?

The public consultation took place on the 4th and 5th September in St Michael and All Angel’s church. However, if you were unable to get to the exhibition at the church you can now view and respond to the consultation via the links below until 5pm on 13th September.

YOUR DRAFT NEIGHBOURHOOD PLAN IN SUMMARY

  • The plan has been drafted based on extensive community input. It is the next step towards finalising the Kingsland Parish Neighbourhood Development Plan.
  • The final Neighbourhood Plan will be our community’s official view of the type and extent of development we would like to see within the parish over the next 16 years ending 2031.
  • This document, if ratified by Herefordshire County Council and our community, will be a statutory reference document for all future planning decisions involving our Parish.

COMMUNITY OBJECTIVES

  • Protect and enhance the rural nature of the parish so that all groups and ages can thrive and develop in a sustainable way
  • Allow for a range of housing size and style which suits their individual settings, location and purpose and the historic pattern of development
  • Strike a balance between satisfying the need for more housing and the needs of a parish and village which strive to remain a typical rural Herefordshire community.
  • Ensure infrastructure is developed in line with the needs of the future growth of the community
  • Ensure new and existing business is beneficial to the economic health of the parish,
  • can grow and is in scale with and sensitive to the rural character of the parish.

WHAT’S NEXT OVER THE COMING MONTHS?

  • The Plan will be amended if necessary, in response to this consultation
  • Formal submission of the Plan to Herefordshire Council for a further six week consultation
  • Independent Examiner appointed to review the Plan
  • Examiner’s Report published
  • Referendum of parish residents on the electoral roll by Herefordshire Council. We estimate this will take place later in 2015
  • If the referendum is in favour, the Plan is adopted by Herefordshire Council
